Rental Agreement
This Rental Agreement (the “Agreement”) is a binding contract between you (“you” or the “Renter”) and Isle of Monday Corp. (“Isle of Monday,” “we,” “us,” or “our”). It governs every rental you place through isleofmonday.com or in person at the Isle of Monday showroom. By checking the acceptance box at checkout and completing your order, you acknowledge that you have read, understood, and agree to be bound by this Agreement, our Terms of Service, our Shipping & Returns Policy, and our Refund & Cancellation Policy, each of which is incorporated by reference. If any term of this Agreement conflicts with those documents, this Agreement controls with respect to your rental.
1. Nature of the Transaction - This Is a Rental, Not a Sale
1.1 Rental only. Every transaction under this Agreement is a rental. You are paying for the temporary right to possess and wear the item(s) identified in your order confirmation (each, an “Item”) for the rental period stated at checkout (the “Rental Period”). Nothing in this Agreement transfers ownership of any Item to you.
1.2 Title. Isle of Monday (or its archivist, where applicable) retains full legal title to every Item at all times, including during the Rental Period. You acquire no ownership interest, security interest, or other right in any Item other than the limited right of temporary use described in this Agreement.
1.3 No right to purchase by non-return. Failing to return an Item does not convert your rental into a purchase, and no fee, charge, or penalty paid under this Agreement - including the unauthorized purchase charge described in Section 5 - grants you ownership of, or any right to keep, an Item unless Isle of Monday expressly confirms a transfer of ownership in writing. For clarity: an Item deemed an unauthorized purchase remains the property of Isle of Monday, which retains the right to charge you as described in Section 5 and will take reasonable efforts to recover the Item from you, including but not limited to demand for return, collection efforts, and the filing of a police report or referral to law enforcement where appropriate.
2. Your Obligation to Return the Item
2.1 Unconditional return. You must return every Item to Isle of Monday by the “Ship back by” or “Return by” date (which are used interchangeably and refer to the same date) stated at checkout and in your order confirmation (the “Return Date”). This obligation is unconditional. It applies regardless of whether you wore the Item, whether the Item fit, whether your event was cancelled, whether you were traveling, and regardless of any other circumstance. If for any reason you cannot return an Item on time, you must contact us at hello@isleofmondaynyc.com before the Return Date. Contacting us does not extend your Return Date or waive any fees unless Isle of Monday expressly agrees in writing. If you fail to contact us and do not return the Item on time, the late fees and non-return charges in Sections 4 and 5 apply automatically and without further notice to you.
2.2 Responsibility for the Item. You are responsible for each Item from the moment it is delivered to you (or collected by you, for local pickup) until it is scanned by the carrier at drop-off (for shipped returns) or returned to and accepted by Isle of Monday in person (for local pickup returns). Loss, theft, or damage occurring during that window is your responsibility, and does not excuse or suspend your obligations under this Agreement.
2.3 Loss or theft. If an Item is lost or stolen while in your care, notify us immediately at hello@isleofmondaynyc.com. We may request supporting documentation, including a police report, travel information, and other documentation reasonably supporting your claim. Loss or theft does not relieve you of the charges described in Sections 4 and 5.
3. How Returns Must Be Made
3.1 Shipped returns. Shipped returns must use the prepaid return label provided with your order and must be dropped off with the designated carrier by the Return Date. A return is considered on time when the carrier scans the package on or before the Return Date. Keep your drop-off receipt; the carrier scan is the timestamp that determines whether a return is on time.
3.2 U.S. returns only. Returns must be shipped from within the United States using the carrier listed on your return label. Shipping a return from outside the United States is prohibited, and such shipments will not be credited as returns. This does not relieve you of your obligation to return the Item: any Item shipped from outside the United States must still be returned through an international return coordinated by Isle of Monday, and late fees continue to accrue until the Item is returned in accordance with this Agreement. If you travel internationally with a rental, do not arrange your own return - contact us immediately at hello@isleofmondaynyc.com, as international returns must be coordinated by Isle of Monday. You are responsible for all costs associated with an international return, including but not limited to shipping and carrier charges, duties, customs and brokerage fees, taxes, and any other cross-border charges, and such amounts may be charged to your payment method under Section 7.
3.3 Local pickup returns. Orders collected in person must be returned in person by the Return Date, by 6:00 PM ET, and may not be returned by FedEx or any other carrier or courier. A local pickup return is complete when the Item is physically handed to an Isle of Monday employee at our location; this hand-off is the timestamp that determines whether a return is on time. Local pickup terms - including NYC presence through the Return Date, government-issued photo ID at pickup, and the restocking fee for ID failures (10% of the rental price, up to $30) - are set out in the Terms of Service and apply to this Agreement. Any handoff to a representative (e.g., a stylist or assistant) requires at least 24 hours' advance notice and Isle of Monday's written approval.
3.4 Packaging. Items must be returned in the garment bag and packaging provided.
3.5 Do not clean or alter. Do not launder, dry-clean, iron, steam, alter, hem, pin through fabric, or otherwise attempt to repair or modify any Item. All cleaning and restoration is performed exclusively by Isle of Monday. Unauthorized cleaning or alteration is treated as damage under Section 4.
4. Late Returns, Damage, and Related Charges
4.1 Late fee. Late returns incur a fee of $50 per day, beginning the day after the Return Date and continuing until the carrier scan (for shipped returns) or in-person acceptance (for local pickup returns).
4.2 Damage. You must return each Item in substantially the same condition in which you received it, ordinary wear associated with careful use excepted. If an Item is returned damaged, stained, altered, or missing components, you authorize Isle of Monday to charge your payment method for the cost of cleaning, repair, restoration, or - where the Item cannot be restored - up to two times the full market value of the Item (as defined in Section 5.1), consistent with Section 5.
4.3 No refund of rental fees. Rental fees paid are not refunded, credited, or deducted against late fees, damage charges, or the unauthorized purchase charge in Section 5.
5. Non-Return - Unauthorized Purchase
5.1 Ten-day rule. If an Item is not returned within 10 days of its Return Date, the Item will be considered an unauthorized purchase, and you authorize Isle of Monday to charge your payment method two times the full market value of the Item, in addition to accrued late fees. Full market value is defined as the replacement value stated on the Item's product page at the time of your order. Rental fees previously paid are not deducted from this amount.
5.2 No transfer of ownership. Payment of the unauthorized purchase charge is a remedy for non-return; it is not a sale and, per Section 1.3, does not transfer ownership of the Item to you. Isle of Monday retains the right to demand return of the Item at any time.
5.3 Rights and remedies. Isle of Monday reserves all rights and remedies available under applicable law relating to unreturned or misappropriated property, including but not limited to account suspension, collection efforts, and the filing of a police report or referral to law enforcement where appropriate.
6. Permitted Use and Care of Items
6.1 Personal use. Items are rented for your use only. You may not sublet, re-rent, lend for consideration, sell, pledge, or otherwise transfer possession of an Item to any third party, and you may not list any Item for sale or resale on any platform. Professional and commercial rentals - including editorial and commercial photography - are welcome and are subject to these terms and the Terms of Service, including any additional documentation or security requirements under the Professional Rentals provisions.
6.2 Reasonable care. You agree to exercise reasonable care in storing, handling, and wearing each Item, consistent with its nature as a rare, archival, or vintage piece, and you agree not to intentionally damage, deface, or destroy any Item.
7. Payment Authorization
7.1 Authorization to charge. By entering into this Agreement, you authorize Isle of Monday to charge the payment method on file for your order for: (a) rental fees and applicable taxes; (b) late fees under Section 4.1; (c) cleaning, repair, or replacement charges under Section 4.2; (d) the unauthorized purchase charge under Section 5.1; (e) international return costs under Section 3.2; and (f) any other amounts you owe Isle of Monday under this Agreement. This authorization continues after the Rental Period ends, until all amounts owed under this Agreement are paid.
7.2 Authorization holds. Isle of Monday may place a temporary authorization hold on your payment method in connection with your rental. A hold is not a charge and is released in accordance with your card issuer's practices. You will be informed of this hold in advance.
7.3 Failed payment. If a charge is declined, you remain liable for the full amount, and Isle of Monday may retry the charge, suspend your account, and pursue collection as described in Section 5.3.
8. Cancellations and Fit Issues
8.1 Cancellations. Cancellations are governed by the Refund & Cancellation Policy: orders cancelled more than 21 days before the scheduled delivery date receive a full refund to the original payment method, minus a $15 fee; cancellations within 21 days receive account credit in the form of a discount code for the order total, minus a $15 fee. Once an Item has shipped, the order is final and may not be cancelled.
8.2 Fit issues. If an Item does not fit, notify us within 12 hours of delivery at hello@isleofmondaynyc.com and ship the Item back - using the prepaid return label provided - within 24 hours of delivery. Provided the Item remains unworn beyond checking fit and is returned within that window, you will receive credit toward a future rental in the form of a discount code. A fit issue does not suspend your obligation to return the Item under Section 2, and an Item not returned within 24 hours remains subject to the original Return Date and all related terms.
9. Contact Information and Transactional Messages
9.1 Phone number required. A valid phone number is a condition of every order. Isle of Monday uses it to send transactional messages about your rental - order confirmations, shipping updates, return reminders, and fee notices - by SMS for U.S. numbers and WhatsApp for international numbers. If you do not provide a valid phone number, or if the number provided is inaccurate, unreachable, or not yours, Isle of Monday reserves the right to refuse or cancel your order and refund your payment. These transactional messages are not marketing or promotional messages and are sent to every customer regardless of marketing preferences. Marketing text messages are sent only if you separately opt in, and you may opt out of marketing messages at any time without affecting transactional messages about your rental. Message and data rates may apply.
9.2 Accurate information. You represent that the name and contact information you provide at checkout are accurate and belong to you, and that you are authorized to use the payment method provided, whether it is your own or one belonging to someone who has permitted you to use it. If the payment method belongs to another person, you represent that the cardholder has authorized the charges described in this Agreement, including any late fees, damage charges, or other amounts under Section 7.
9.3 Third-party payment methods. Your obligations under this Agreement - including responsibility for each Item and liability for all charges - are yours regardless of whose payment method is used, and are not reduced or transferred by paying with a card belonging to another person. If you use a payment method belonging to another person, you represent that the cardholder has reviewed and consented to this Agreement and has authorized all charges that may arise under it, including late fees, damage charges, and the unauthorized purchase charge, from the moment of purchase. By permitting their payment method to be used, the cardholder agrees that it remains authorized for all such charges until all amounts owed under this Agreement are paid.
10. General Terms
10.1 Electronic acceptance. You agree that checking the acceptance box at checkout and completing your order constitutes your electronic signature and acceptance of this Agreement, with the same force and effect as a handwritten signature, in accordance with the U.S. E-SIGN Act and applicable state law.
10.2 Governing law. This Agreement is governed by the laws of the State of New York, without regard to conflict-of-laws principles.
10.3 Entire agreement. This Agreement, together with the Terms of Service, Shipping & Returns Policy, Refund & Cancellation Policy, and any other policy expressly incorporated by reference at checkout or in these documents, constitutes the entire agreement between you and Isle of Monday regarding your rental and supersedes any prior or contemporaneous statements, representations, or communications. If any provision is held unenforceable, the remaining provisions remain in full force.
10.4 Changes. Isle of Monday may update this Agreement from time to time. The version in effect at the time you place an order governs that order.
