Terms of service
Welcome to Isle of Monday ("Isle of Monday," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, mobile applications, and related services (collectively, the "Services"), which allow users to rent women's luxury vintage, archival, and designer clothing and accessories.
Please read these Terms carefully. By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, do not access or use the Services.
1. Eligibility and Account Creation
To rent from Isle of Monday, you must:

Be at least eighteen (18) years old and capable of entering into a legally binding agreement;

Provide accurate, complete, and current information during registration and checkout;

Maintain the confidentiality of your account credentials; and

Accept responsibility for all activity occurring under your account.
You agree to promptly update your account information if it changes.
We reserve the right to refuse service, suspend, limit, or terminate any account that violates these Terms, provides inaccurate information, engages in fraudulent activity, or otherwise poses risk to Isle of Monday or its users.
2. Rentals and Product Care
The Services allow you to rent luxury vintage, archival, and designer clothing and accessories (each, an "Item" and collectively, the "Items") for a limited rental period specified at checkout.
You agree to:

Treat all Items with reasonable care;

Not alter, repair, wash, dry clean, dye, tailor, or otherwise modify any Item;

Use Items only for their intended purpose;
-
Protect Items from theft, loss, damage, excessive wear, and deterioration;
-
Return Items by the specified return date using the return method provided by Isle of Monday.
All cleaning, garment care, restoration, and maintenance shall be performed exclusively by Isle of Monday or its designated partners.
Vintage and Archival Condition
Items available through Isle of Monday are rare, collectible, archival, vintage, or otherwise difficult to replace. Because of their age, provenance, and prior use, Items may exhibit minor imperfections, repairs, restoration work, signs of wear, fabric irregularities, fading, discoloration, loose threads, or other characteristics consistent with their history.
These characteristics are inherent to vintage and archival fashion and do not constitute defects, damage, or misrepresentation. You acknowledge and accept that such characteristics may be present and are part of the nature and value of the Item.
Nothing in this section limits your responsibility for preserving the condition of an Item. You remain responsible for any loss, theft, significant damage, unauthorized alterations, or other material deterioration occurring while the Item is in your possession or control. You agree to return the Item in substantially the same condition in which it was received, ordinary wear associated with careful use excepted.
Loss, Theft, Damage, and Failure to Return
You are responsible for all Items from the time they are delivered to you until they are scanned by Isle of Monday's designated return carrier.
If an Item is lost, stolen, misplaced, damaged beyond repair, confiscated, abandoned, or otherwise becomes unavailable for return while in your possession or control, you must notify Isle of Monday within twenty-four (24) hours of becoming aware of such event by emailing hello@isleofmondaynyc.com.
You agree to cooperate fully with Isle of Monday and provide any information, documentation, reports, claim numbers, correspondence, photographs, tracking information, insurance records, airline claims, police reports, or other materials reasonably requested in connection with any investigation, recovery effort, insurance claim, travel-related claim, or risk management process.
Loss, theft, damage, or unavailability of an Item does not relieve you of your financial responsibility under these Terms.
Isle of Monday may document the condition of Items before shipment and upon return, including through photographs, videos, inspection reports, or other records, which may be used in determining responsibility for loss or damage.
You are responsible for any damage to, loss of, theft of, or failure to return an Item. Isle of Monday reserves the right to charge you up to two (2) times the full market value of the Item, as determined by Isle of Monday in its reasonable discretion.

3. Stylist, Production, and Commercial Rentals
Isle of Monday welcomes rentals for stylists, creative directors, production companies, photographers, publications, brands, and other commercial users ("Professional Rentals").
All Professional Rentals are subject to these Terms unless otherwise stated in a separate written agreement.
By confirming a Professional Rental, you acknowledge and agree that:

You may be required to provide a business name, tax identification number, certificate of insurance, or other documentation upon request;

You assume full responsibility for the care, security, and return of all rented Items;

Isle of Monday may require additional security deposits or other protections for high-value Items.
No Sub-Renting or Third-Party Transfers
You may not loan, rent, sublicense, consign, exchange, transfer, distribute, or otherwise provide any rented Item to a third party.
You remain solely responsible for all Items throughout the rental period.
4. Payment and Fees
Rental orders are subject to the fees displayed at checkout.
By placing an order, you authorize Isle of Monday and its payment processors to charge your payment method for:

Rental fees;

Applicable taxes;
-
Shipping charges;
-
Late fees;
-
Damage fees;
-
Replacement costs;
-
Recovery costs;
-
Collection costs; and
-
Any other amounts owed under these Terms.
Payment Authorization
By creating an account, placing an order, or providing a payment method, you authorize Isle of Monday and its third-party payment processors to store your payment credentials and charge your payment method for all amounts owed under these Terms. You confirm that you are authorized to use the payment method provided and agree to keep your payment information current and valid throughout the rental period and until all obligations under these Terms have been fulfilled.
Authorization Holds
Isle of Monday reserves the right to place temporary authorization holds, verification charges, or pre-authorizations on your payment method before, during, or after a rental period for purposes including fraud prevention, payment verification, risk management, and securing potential charges related to a rental transaction.
Text Message Communications
By providing your mobile number at checkout, you acknowledge that a valid, text-capable mobile number is required to place an order and consent to receive text messages from Isle of Monday related to your order, including (but not limited to) order confirmation, shipping, delivery, return reminders, overdue notices, and notifications of any late fees or charges applied to your order.
We use your number only for these order-related updates and never for marketing. Message frequency depends on your order activity, and message and data rates may apply. A valid, text-capable mobile number is required to check out; orders cannot be completed without one. Because text communication is required to complete a rental, replying STOP will unsubscribe you, but may result in cancellation of your order and may prevent you from placing future orders.
Late Returns
Late returns will incur a fee of fifty dollars ($50) per day.
If an Item is not returned within ten (10) days of the due date, Isle of Monday may deem the Item an unauthorized purchase and permanently unreturned, and may charge you an amount equal to two (2) times the full market value of the Item, as determined by Isle of Monday in its reasonable discretion.
Isle of Monday reserves all rights and remedies available under applicable law relating to unreturned or misappropriated property, including but not limited to account suspension, collection efforts, and the filing of a police report or referral to law enforcement where appropriate.
Chargebacks and Payment Disputes
If you initiate a chargeback, payment dispute, reversal, or similar claim relating to a charge that Isle of Monday reasonably believes is valid, Isle of Monday reserves the right to suspend or terminate your account, refuse future rentals, pursue collection of outstanding amounts, and recover any fees or expenses incurred in responding to the dispute.
Collection Costs
You agree to reimburse Isle of Monday for all reasonable costs incurred in collecting unpaid amounts or recovering unreturned Items, including collection agency fees, attorneys' fees where permitted by law, court costs, investigative expenses, shipping recovery expenses, and other reasonable recovery costs.
We do not accept prepaid cards.
Prices and fees may change at any time, but changes will not affect confirmed orders.
5. Shipping, Pickup and Returns
Isle of Monday provides prepaid return labels and packaging for rental orders.
Rentals are returned either by shipping or, where offered, by local pickup and in-person return (see below). You must return your order by the due date stated at checkout. For shipped orders: returns must be shipped from within the United States by the due date, and returns shipped from outside the United States will not be accepted.
If you travel internationally with an Item, you remain solely responsible for ensuring it is returned from within the United States using the return method provided by Isle of Monday.
Local Pickup and In-Person Returns
Isle of Monday offers local pickup for orders in the New York City area, selected at checkout. By selecting local pickup, you agree to the following:
(a) Eligibility. You confirm that you will be present in the New York City area through your Return by date and able to return the Item in person. Isle of Monday reserves the right to determine eligibility and to refuse or cancel local pickup where these conditions aren't met.
(b) In-person collection and return. Orders collected in person must also be returned in person to Isle of Monday by 4:00 PM ET on the Return by date stated at checkout. Local pickup orders may not be returned by FedEx or any other carrier or courier service.
(c) Identification required. A valid government-issued photo ID matching the name on the order is required at the time of pickup. Isle of Monday reserves the right to refuse release of an Item if identification cannot be provided or does not match the order. In such cases, the order will be cancelled and refunded, less a restocking fee of 10% of the rental price, up to a maximum of $30.
(d) No third-party handling. Pickup and return must be completed by the customer named on the order. In limited cases, and at Isle of Monday's sole discretion, an authorized representative may be approved to collect or return an order on the customer's behalf — for example, a stylist or assistant acting for the customer. Any such arrangement must be requested by the customer 24 hours in advance and confirmed by Isle of Monday in writing; approval is not guaranteed. An approved representative must present valid photo ID matching the name provided in advance. Couriers, messengers, and other commercial or third-party delivery services are not permitted in any case.
(e) Timing and responsibility. For local pickup orders, responsibility for the Item passes to you upon collection and remains with you until the Item is returned to and accepted by Isle of Monday in person. A return is on time only if made by 4:00 PM ET on the Return by date; returns after that time are late and subject to the same fees set out in these Terms, calculated from the Return by date.
(f) Text message communication. A valid mobile number capable of receiving text messages — by SMS for U.S. numbers, or by WhatsApp for international numbers — is required to place any order with Isle of Monday. Because we rely on text messaging to communicate order updates, delivery and pickup coordination, and return reminders, a working mobile number capable of receiving SMS or WhatsApp messages is a condition of using our Services. These messages are used solely for transactional purposes related to your order — including order updates, coordination, timing, and returns — and never for marketing. If you are unable or unwilling to receive transactional messages by SMS or WhatsApp, you will not be able to place an order.
Travel and Checked Baggage
You may travel with Items at your own risk. Isle of Monday strongly recommends transporting all rented Items in carry-on luggage whenever possible.
If an Item is lost, delayed, misplaced, damaged, or otherwise becomes unavailable due to airline handling, baggage loss, baggage delay, hotel loss, theft, transportation incidents, customs issues, or any travel-related circumstance, you remain fully responsible for the Item and all associated obligations under these Terms.
Shipping Delays
While Isle of Monday makes every effort to ensure timely delivery, delays may occasionally occur due to shipping carrier issues, weather events, natural disasters, labor disputes, governmental actions, transportation interruptions, public health emergencies, or other circumstances beyond our reasonable control.
Isle of Monday shall not be liable for delays or failures in performance resulting from such circumstances. However, if a delay prevents fulfillment of a rental order, Isle of Monday may, in its sole discretion, provide a refund, account credit, replacement Item, adjusted rental period, or another reasonable accommodation. Delivery dates are estimates only and are not guaranteed.
International Travel and Returns
All rentals are issued with a prepaid return label for return from within the United States, and Items must be returned from within the United States by the Return by date. We strongly recommend against traveling internationally with a rented Item.
If you travel outside the United States with an Item, you remain fully responsible for the Item until it is safely returned to and received by Isle of Monday. If you are unable to return the Item from within the United States, you must contact Isle of Monday immediately at hello@isleofmondaynyc.com. You are not authorized to return an Item internationally using your own shipping label, carrier, or method. All international returns must be coordinated by Isle of Monday through our trusted shipping partners, at our sole discretion.
You are solely responsible for all costs associated with an international return, including international shipping, customs duties, import fees, taxes, brokerage fees, and any other charges incurred, which may total hundreds or thousands of dollars. You authorize Isle of Monday to charge your payment method on file for all such costs.
Isle of Monday is not responsible for Items lost, delayed, damaged, seized, or held in customs during international transit. Any Item lost or not returned will be deemed an unauthorized purchase and permanently unreturned, and you will be liable for up to two (2) times the full market value of the Item, in addition to any return and import costs incurred.
6. Cancellations and Refunds
You may cancel an order more than twenty-one (21) days before the scheduled delivery date and receive a full refund to your original payment method, less a $9.95 processing fee.
Cancellations made within twenty-one (21) days of the scheduled delivery date are not eligible for a refund but will receive account credit in the form of a gift card equal to the order value, less a $9.95 processing fee.
Once an Item has shipped, the order is final and may not be canceled.
7. Ownership
All Items remain the sole property of Isle of Monday and/or its partners at all times.
You acquire no ownership rights by renting an Item.
You may not sell, pledge, loan, transfer, consign, exchange, sublicense, or otherwise dispose of any Item.
Fit and Sizing Disclaimer
Isle of Monday does not guarantee fit, sizing accuracy, comfort, or suitability of any Item.
Measurements, size designations, fit recommendations, and information provided through the Services, including the "Will This Fit Me?" module, are provided for informational purposes only and may vary due to garment age, designer sizing standards, alterations, manufacturing differences, fabric characteristics, or prior wear.
You are solely responsible for determining whether an Item is appropriate for your intended use.
By using the "Will This Fit Me?" module, you acknowledge that Isle of Monday may collect, store, and associate sizing information, measurements, and fit preferences with your account in accordance with our Privacy Policy.
8. Platform Changes and Feedback
We may modify, suspend, or discontinue portions of the Services at any time.
If you provide feedback, suggestions, reviews, ideas, or recommendations regarding the Services, you grant Isle of Monday a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, modify, display, and otherwise utilize such feedback without compensation.
9. Intellectual Property
All content available through the Services, including text, images, graphics, logos, software, trademarks, and designs, is owned by or licensed to Isle of Monday and is protected under applicable intellectual property laws.
You may not reproduce, distribute, modify, create derivative works from, or otherwise use such content without prior written permission.
10. Termination
Isle of Monday reserves the right, in its sole discretion, to refuse service, cancel orders, limit rentals, suspend accounts, terminate accounts, or permanently prohibit future rentals for any reason permitted by law, including suspected fraud, abuse of the Services, excessive disputes or chargebacks, violation of these Terms, non-payment, or failure to return Items.
Any obligations accrued prior to termination shall survive termination.
11. Disclaimers and Limitation of Liability
THE SERVICES AND ITEMS ARE PROVIDED "AS IS" AND "AS AVAILABLE."
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ISLE OF MONDAY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW:

ISLE OF MONDAY'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID FOR THE RENTAL GIVING RISE TO THE CLAIM; AND
-
ISLE OF MONDAY SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES.
12. Mandatory Individual Arbitration and Class Action Waiver
Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved exclusively through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules.
You and Isle of Monday waive any right to participate in any class action, collective action, representative action, or jury trial.
The arbitration shall take place in New York County, New York.
Either party may bring an individual claim in small claims court if the claim qualifies and remains on an individual basis.
This arbitration provision survives termination of your account, these Terms, and your use of the Services.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles.
14. Changes to the Terms
We may modify these Terms at any time.
Material changes will be posted on the Services with an updated "Last Updated" date.
Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
15. Electronic Communications
By creating an account or using the Services, you consent to receive communications from Isle of Monday electronically, including rental confirmations, transactional emails, account notices, payment notices, legal notices, and other communications relating to your use of the Services.
You agree that electronic communications satisfy any legal requirement that such communications be in writing.
